    TERMS OF USE FOR ALL USERS

    BY USING OUR WEBSITE YOU AGREE TO THESE TERMS – PLEASE READ THEM CAREFULLY

    1. GENERAL PROVISIONS FOR ALL USERS
    1.1 These Terms of Use for all Users govern the use of this website, referred as EscoGram and accessed via the URL www.escogram.com , and the agreement of the user with us.
    1.2 In the Terms of Service:
    a. we refer to our website as EscoGram, including when accessed via the URL www.EscoGram.com;
    b. references to we, our, us are references to Bosa Group S.R.L., the owner and operator of EscoGram;
    c. User Content(s) means any material uploaded to EscoGram by a User, including any photos, videos, audio, livestream material, data, text (such as comments, reviews and hashtags), metadata, images, interactive features, emojis, GIFs, memes, and any other material whatsoever;
    d. User means that person who accesses EscoGram and who is interested in the Services provided by Bosa Group S.R.L.
    e.Model means a User who has set up his/her EscoGram account to post User Content on EscoGram to be viewed by Clients; Model’s User Content may be freely available or pay-per-view on the basis of free and autonomous choice of the Model;
    f. Client means a User who follows a Model and is able to view the Model’s Content;
    g. Affiliate means a User who helps EscoGram to populate, bringing new Users who register as Models and, for this reason, receives remuneration for this promotional activity;
    h. Client – Model Transaction means any transaction (payment) between a Client and a Model on EscoGram by which access is granted to the pay-per-view Model’s User Content (pay-per-view media and pay-per-view live stream);
    i. Client Payment means any and all payments made by a Client to a Model in connection with a Client – Model Transaction;
    j. Membership Plan means the subscription plans that Models can opt for a fee for the use of services dedicated to them, in relation to the activation of a personal page and the publication of User Content and other information on it;
    k. Registered User means falling into the Client, Model and Affiliate categories.
    l. Agreement between Client and Model means the terms which govern each Client - Model Transaction, which can be found here;
    m. Terms of Service (also called your agreement with us) means the legally binding agreement between you and us which consists of: (i) these Terms of Use for all Users, (ii) Terms of Use for Clients, (iii) Terms of Use for Models, (iv) Terms of Use for Affiliate, (v) Privacy Policy, and (vi) Complaints Policy;
    n. Tax shall include all forms of tax and statutory, governmental, state, federal, provincial, local government or municipal charges, duties, imposts, contributions, levies, withholdings or liabilities wherever chargeable and whether of Romania or any other jurisdiction;
    o. VAT means Romanian value added tax and any other tax imposed in addition to or in substitution for it at the rate from time to time imposed and any equivalent or similar governmental, state, federal, provincial, or municipal indirect tax, charge, duty, impost or levy in any other jurisdiction.
    1.3 EscoGram is operated by BOSA GROUP S.R.L., a Romanian legal entity, registered at the Trade Register Office attached to the Bucharest Tribunal under no. J2024012889404, having a unique registration code 50305303, headquartered in Bucharest, 3rd District, Sector 3, 317. Calea Călărași street, 1st floor, ap. 2, room nr. 8, e-mail: info@bosagroups.com .     1.4 Accessing to EscoGram, using it and navigating through its pages, automatically confer the status of User and imply the full acceptance of the present Terms of Use for all Users, as well as of the Privacy Policy, Cookie Policy, Return & Cancellation Policy, Anti-slavery Policy and any other note, legal notice, statement or disclaimer that may be published anywhere on EscoGram, which shall all be deemed legally binding for Users as provided under Romanian law.
    1.5 In any case, EscoGram is not intended for minors. Only adults who are at least eighteen (18) years old and who have reached the age of majority where they reside may access EscoGram. If you do not meet these age requirements, you must not access EscoGram and must leave now. Bosa Group S.R.L. forbids all persons who do not meet these age requirements from accessing EscoGram.
    1.6 Users who do not intend to accept one or more of these Terms of Service are invited to immediately interrupt the use of EscoGram.
    1.7 Users undertake to use EscoGram and any data, information or material available on it only for legitimate purposes, in accordance with the present Terms of Service and with the current and applicable legislation, assuming all legal responsibilities that may arise from unlawful use of EscoGram and its Contents and/or from the violation of any applicable legislation.
    1.8 We do not guarantee the truthfulness and accuracy of information and User Contents present on EscoGram.
    1.9 The User agrees that:
    a. if any part of the agreement is unenforceable, the remaining provisions will still apply;
    b. if we do not enforce a provision of the agreement, it does not mean we waive our right to do so in the future;
    c. we reserve all rights not expressly granted to the User or to third parties;
    d. no implied licenses or rights are granted to the User concerning any part of EscoGram, except as explicitly stated in the Terms of Service;
    e. the User cannot transfer his/her rights or obligations under this agreement without our prior written consent;
    f. we can assign or transfer our rights and obligations under this agreement to others; this might happen if our ownership changes due to a merger, acquisition, or sale of assets, or as required by law. We may also delegate the performance of any of our obligations to third parties, but we will remain responsible for their performance.
    1.10 These Terms of Use for all Users govern User’s agreement with us, superseding any prior oral or written agreements. Certain other terms or policies forming part of the Terms of Service will also apply to the User and form part of User’s agreement with us, as follows:
    a. Terms of Use for Clients – which contain additional terms which apply if the User uses EscoGram as a Client;
    b. Terms of Use for Model – which contain additional terms which apply if the User uses EscoGram as an Model;
    c. Terms of Use for Affiliate – which contain additional terms which apply if the User uses EscoGram as an Affiliate;
    d. Privacy Policy – which applies to all Users and inform on why and how we use User’s personal data, pursuant to art. 13 GDPR;
    e. Complaints Policy - which sets out the procedure for making a complaint about any aspect of EscoGram, and how we will deal with that complaint;
    f. Cookie Policy – which applies to all Users and inform on why and how we use User’s cookies;
    g. Return & Cancellation Policy – which applies to all Users and provides information on your rights of withdrawal from the agreements and of cancellation of the agreement;
    h. Anti-slavery Policy - which applies to the company, its business partners and Users and inform on how we fight against slavery and human-trafficking activities.
    1.11 In the event of any conflict between these Terms of Use for all Users and the terms or policies referenced in section 1.9 above, the Terms of Use for all Users will prevail to the extent of the conflict.
    1.12 To conclude any contract on EscoGram it is currently available only the English language.
    2. SERVICES
    2.1 Each category of Users is offered services better described in the respective Terms of Use.
    2.2 We allow, for free, all the Registered Users to:
    a. communicate with each other on EscoGram through private instant messages, sending images and videos;
    b. access to public User Content of the Model on their personal page.
    2.3 Anyway, it is not possible – and it is strictly forbidden – to form a contract, through EscoGram, between any User and a Model regarding escort or prostitution services. We are not, and cannot be considered, a mediator, intermediary, or party to any agreements between the User, Model and any other individual regarding the escort or prostitution services.
    2.4 We do not provide dating services and we do not offer appointment mediation services. EscoGram will not be responsible for any meetings between models and clients. Clients can view photos and videos, start chats, purchase content or webcam services, and find contact numbers, but appointments cannot be arranged through the platform.
    3. DURATION AND MODIFICATION OF TERMS OF SERVICE
    3.1 The content of these Terms of Service can be modified at any time by Bosa Group S.R.L.
    3.2 In case of substantial changes, we will give Registered Users reasonable notice of such changes by e-mail or through EscoGram and allowing them to withdraw from the contract before the changes come into force. The withdrawal will be regulated, for each User category, in the respective Terms of Use.
    3.3 Once any update of Terms of Service (including Terms of Use for all Users, Terms of Use for User, Terms of Use for Model, Terms of Use for Affiliate, Privacy Policy, Complaint Policy, Cookie Policy, Return & Cancellation Policy, Anti-slavery Policy) are in effect, Users will be bound by them if they continue to use EscoGram.
    3.4 Users that are not Registered Users are therefore invited to constantly consult the present Terms of Service in order to be always informed about the conditions applied.
    3.5 Even after terminating the use of EscoGram, the following provisions of the present Terms of Service will remain in force and continue to be binding, due to their ultractivity. In particular they concern:
    a. the exclusion and limitation of our liability;
    b. the law applicable;
    c. jurisdiction and competent Court to settle eventual disputes.
    3.6 We reserve the right to suspend or interrupt, temporarily or permanently, the functions of EscoGram at any time and for any reason, including the access to the website, to its pages, Contents or related services. The User acknowledges that, for these operations we will in no way be liable towards Users or third parties.
    3.7 The Terms of Service last as long as EscoGram is in operation. The specific Terms of Use for the categories of Registered Users will have a distinct duration depending on each category, and their duration will be regulated in the respective Term of Use.
    4. CONTENTS, INTELLECTUAL PROPERTY, TRADEMARKS AND DOMAIN NAMES
    4.1 EscoGram, including all its logos, trademarks, distinctive signs, web pages, ideas, graphics, audio-visual materials, but except User Contents, are owned by Bosa Group S.R.L.
    4.2 These contents cannot be reproduced, used or represented by the User, least of all for purposes that can be considered illicit and/or are expressly prohibited by the present Terms of Service, except in cases and within the limits expressly recognised by us or in cases and within the limits permitted by the law.
    4.3 Users are also not authorised, unless otherwise provided by us, to use the above mentioned trademarks for distinguishing other goods or services, even if not similar to those available on EscoGram or belonging to other trademark owners.
    4.4 We undertake to remove, as early as possible, any content declared unlawful by a Judicial Authority. Likewise, it will be removed any content considered illicit as established in our sole discretion and eventually reported by Users. In this case, we will properly inform the competent authority.
    4.5 In case we would ascertain, directly or after Users’ report, the infringement of the relevant national and/or international legislation, we reserve the right to interrupt the access to EscoGram, as well as to its specific contents and materials.
    4.6 User confirms that he/she owns all intellectual property rights in his/her Content or that he/she has obtained all necessary rights to his/her Content which are required to grant licenses in respect of his/her Content to us and to other Users. This includes any rights required to engage in the acts covered by sub-section 4.7 below in any territory in which EscoGram is accessible.
    4.7 User agrees to grant us a license under all his/her User Content to perform any act restricted by any intellectual property right (including copyright) in such Content, for any purpose reasonably related to the provision and operation of EscoGram. Such acts include to reproduce, make available and communicate to the public, display, perform, distribute, translate, and create adaptations or derivative works of Content, and otherwise deal in Content.
    4.8 The license which the User grants to us under sub-section 4.7 above is perpetual, non-exclusive, worldwide, royalty-free, sublicensable, assignable and transferable by us. This means that the license will continue even after User’s agreement with us ends and the User stop using EscoGram, that we do not have to pay the User for the license, and that we can grant a sub-license of User Content to someone else or assign or transfer the license to someone else. This license will allow us, for example, to add stickers, text, and watermarks to User Content, to make User Content available to other Users of EscoGram, as well as to use User Content for other normal operations of EscoGram. We will never sell User Content to other platforms, though we may sell or transfer any license the User grants to us in the Terms of Service in the event of a sale of our company or its assets to a third party.
    4.9 Whilst we are not the owner, the User grant us, in relation to his/her User Contents, the limited right to submit notifications of infringement (including of copyright or trademark) on User’s behalf to any third-party website or service that hosts or is otherwise dealing in infringing copies of User Content without User’s permission. Although we are not under any obligation to do so, we may at any time submit or withdraw any such notification to any third-party website or service where we consider it appropriate to do so. However, we do not and are under no obligation to police infringements of User Contents. The User agrees that if we request, User will provide us with all consents and other information which we reasonably need to submit notifications of infringement on his/her behalf. Please see our Complaints Policy for how to make a complaint about infringement of intellectual property rights.
    4.10 User waives any moral rights which he/she may have under any applicable law to object to derogatory treatment of any Content posted on EscoGram. This waiver does not affect in any way User’s ownership of any intellectual property rights in his/her User Content or the rights which User has to prevent his/her User Content from being copied without permission. The waiver is intended to allow us when dealing with User Content (as permitted by the license which User gives us in section 4.7 above) to add watermarks, stickers or text to User Contents.
    5. REGISTERING WITH ESCOGRAM
    5.1 To use EscoGram, it is necessary to register and create a User account.
    5.2 The User must provide his/ her First name, Last name, a valid e-mail address, a username and a password, or authenticate using a valid Google account. User’s password should be unique, different to those used for other website, and must comply with the technical requirements of the EscoGram site for the composition of passwords.
    5.3 To register:
    a. the User must be at least 18 years old, and he/she will be required to confirm this;
    b. the User must communicate the following information: name, surname, gender, date of birth, e-mail address, mobile number;
    c. if the laws of the country or State/province where the User lives provide that a User can only be legally bound by a contract with us at an age which is higher than 18 years old, then the User must be old enough to be legally bound by a contract with us under the laws of the country or State/province where the User lives;
    d. the User must be permitted by the laws of the country or State/province where he/she is located to join EscoGram and to view any content available on it and to use any functionality provided by it.
    5.4 The system will automatically send to the User an e-mail confirming the registration.
    5.5 The User that does not meet the above requirements, will not access or use EscoGram.
    5.6 When the registration procedure will be successfully completed, the Registered User will be able to have access to his/her personal account section, which offers information and functionality services that differ depending on the User’s category and that will be better described in the respective Terms of Use.
    5.7 Users shall note that, after accessing to any EscoGram section through a public computer (for example in a internet point, public library, university classroom, etc.), is advisable to carefully perform the log-out procedure after the last session of use; otherwise, other users of the same device may have access to the account previously used.
    5.8 Moreover, in case of access from mobile devices (for example: smartphone or tablet), through web browser or application, it is possible that, basing on device’s setting, the User account remains connected; we therefore suggest to protect your mobile devices with a password and, if lost or stolen, to use the remote data cancellation option (if available) to delete all personal information stored on the device and, ultimately, change the password of the account registered on EscoGram.
    5.9 Account credentials (e-mail address and password) shall be used exclusively by the User and may not be shared with third parties. The Registered User undertakes to retain these credentials with confidentiality, ensuring that no one can access them, and to promptly inform us in case of an unauthorised access or improper use of these credentials.
    5.10 Each User can create only one personal account on EscoGram: is therefore expressly prohibited to make multiple registrations.
    5.11 We reserve the right to delete a User account in case of violation of the present Terms of Service, or in case that the personal data provided by the User are not complete, truthful and correct, without prejudice to damages.
    5.12 Registered Users may, at any time and for any reason, request the cancellation of their account by sending an e-mail to support@EscoGram.com. Users will receive the relative deletion confirmation via e-mail.
    6. DELETION OF USER’S ACCOUNT
    6.1 The User may delete his/her EscoGram account directly in the User’s Dashboard, by clicking on the appropriate button Delete Account.
    6.2 The deletion of the account will take place within a reasonable time following the request. The User will receive an email confirmation upon the successful deletion of the account.
    6.3 Once User account has been deleted, the User won’t be charged any further amounts or have access to the former EscoGram account or its Contents, any membership plan will be deleted and cannot be subsequently renewed.
    6.4 Once User account has been deleted, we may deal with User Contents in any appropriate manner in accordance with our Terms of Service and Privacy Policy. There is no technical facility on EscoGram for the User to be able to access to his/her User Contents following termination of his/her account.
    7. USER’S OBLIGATIONS
    7.1 The User undertakes to make diligent use of EscoGram and of the services available therefrom, in full observance of European and Romanian Law, good morals and the Terms of Service, as well as any other note, legal notice, statement or disclaimer that we may have published anywhere on EscoGram.
    7.2 All information provided by the User through whatever means, aimed at obtaining the provision of the services offered by us on EscoGram, must be truthful and complete, and always updated. In any case, the User will be solely responsible for eventual false and/or incomplete declarations, false and/or incomplete information provided, as well as eventual damages incurred by us or third parties for this misconduct.
    7.3 The User will keep account details confidential and secure, including username, passwords and any other piece of information that forms part of our security procedures, and will not disclose these to anyone else. The User will contact support@EscoGram.com promptly if he/she believes someone has used or is using User’s account without permission or if User’s account has been subject to any other breach of security. The User also ensures to log out of User’s account at the end of each session, and to be particularly careful when accessing User’s account from a public or shared computer so that others are not able to access, view or record your password or other personal information.
    7.4 The User is responsible for all activity on his/her account even if, contrary to the Terms of Service, someone else uses such account.
    7.5 Moreover, Users shall not (by way of non-exhaustive example):
    a. make use of tools, software or scripts that might be detrimental to EscoGram and related tools and systems for the provision of its services;
    b. violate or attempt to alter any aspect of the services provided on EscoGram;
    c. impersonate us, one of our employees, another User, or any other person or company or falsely state or suggest any affiliation, endorsement, sponsorship between you and us
    d. block, overwrite, modify or copy where it is not necessary for the proper use of the services provided on EscoGram;
    e. reproduce contents making use of robot/crawler search engines;
    f. reproduce and disclose EscoGram contents to the public without our prior authorization;
    g. manipulate data and contents present on EscoGram;
    h. undertake any action that might hinder the proper functioning of our and EscoGram infrastructure;
    i. commit or encourage an offence or a crime, or stalk, bully, abuse, harass, threaten, intimidate or disturb other Users and anyone else;
    j. send unsolicited material, also known as spam;
    k. transmit and/or spread any virus, trojan, worm, malware, logic bomb, or any other material that might be technologically harmful;
    l. violate confidentiality and privacy or be in any way obscene or offensive;
    m. infringe property rights, including industrial and intellectual property, and any other right of other Users and any person;
    n. use EscoGram except for your own personal use and in a manner and for a purpose that is unlawful;
    o. sell, rent, transfer, or share User’s account or any User Content obtained from the use of EscoGram to or with anyone else;
    p. upload, post, display, or publish User Content on EscoGram:
    • that is illegal, fraudulent, defamatory, hateful, discriminatory, threatening or harassing, or which encourages or promotes violence or any illegal activity, or is used or is intended to be used to extract money or another benefit from anyone else in exchange for removal of the User Content,
    • that shows, includes or refers to any minor or any other individual unless the User has written documentation which confirms that all individuals shown or included or referred to in User Content are at least 18 years old, and the User has a written consent from each individual to use their name or images (or both) in the User Content,
    • that shows, promotes, advertises or refers to firearms, weapons, or any goods whose sale, possession or use is subject to prohibitions or restrictions, drugs, self-harm or suicide, incest, bestiality, necrophilia, urine, scatological, or excrement-related material, violence, rape, lack of consent, hypnosis, intoxication, sexual assault, torture, sadomasochistic abuse or hardcore bondage, extreme fisting, or genital mutilation, revenge porn, deepfakes, hate speech, anyone else’s personal data or private or confidential information without express written consent,
    • that causes or is calculated to cause inconvenience, or anxiety to anyone else or which is likely to upset, embarrass, or cause serious offence to anyone else,
    • gives the impression that it comes from or is approved, licensed or endorsed by us,
    • contains public nudity or sexual activities recorded or broadcast from a country, State or province where such activities are illegal,
    • that involves or promotes third-party commercial activities or sales, such as contests, sweepstakes and other sales promotions, product placements, advertising, or job posting or employment ads without our prior express consent,
    q. use EscoGram in any way which may exploit, harm, or attempt to exploit or harm any minor, for example by exposing them to inappropriate User Content;
    r. provide false account registration information or make unauthorized use of anyone else’s information or User Content;
    s. post or cause to be posted any User Content which is spam, which has the intention or effect of artificially increasing any view or interaction, or which is otherwise inauthentic, repetitive or misleading;
    t. use other media or methods to communicate anything which violates Terms of Service.
    8. ESCOGRAM’S LIABILITY
    8.1 EscoGram and all related services are offered as is, without any operation guarantee.
    8.2 The User acknowledges that the use of EscoGram and its services is at his/her own risk. In particular, we don’t provide any specific guarantee on eventual expected results, desired or achieved through the use of EscoGram and relative services, and cannot be held liable for User’s claims related to the use or malfunction of EscoGram or its services.
    8.3 We have adopted technical and organizational measures to protect the security and integrity of personal data relating to services, traffic and electronic communications, in order to avoid risks of damage or destruction of confidential data and information regarding Users, as well as unauthorised or non compliant accesses to these data and information.
    8.4 The User acknowledges and agrees that we cannot be held in breach of our obligations or considered liable in case of delays and malfunctions of EscoGram or its services, as well as in case of damages, direct or indirect, caused to Users or to third parties, that are not a foreseeable result of our breaching the Terms of Service or are resulting from events occurring beyond our reasonable and physical control, such as, by way of non-exhaustive example:
    a. the User’s inability to use EscoGram or any of its services, features, or programs; or
    b. the User’s use of or reliance on any content (including User Content) stored on EscoGram;
    c. malfunction and/or failure of the services provided by telecommunications operators and/or of the electrical equipment and lines, as well as of telephone and/or digital and cyber connections not directly managed by us or by persons acting under our responsibility;
    d. malfunction of the terminals or other systems of communication used by the User;
    e. actions undertaken by other Users or persons having access to the same Internet connection;
    f. distributed denial-of-service attack, virus, malware, ransomware, or other technologically harmful material that may infect the User’s computer equipment, programs, data, or other proprietary material due to the User’s use of EscoGram or any of its services, features, or programs, or due to the User’s downloading of any material posted on it, or on any website linked to it;
    g. other events deriving from accidental circumstances and/or force majeure;
    h. loss or damage incurred because of the use of any Content posted, emailed, sent, or otherwise made available through EscoGram;
    i. User Content or any conduct by Users that violates these Terms;
    j. Personal injury or property damage resulting from your access to and use of EscoGram.
    8.5 We do not promise that EscoGram is compatible with all devices and operating systems. The User is responsible for configuring his/her information technology, device, and computer programs to access EscoGram.
    8.6 We are not responsible for the availability of the Internet, or any errors in User’s connections, device or other equipment, or software that may occur in relation to the use of EscoGram.
    8.7 While we try to make sure that EscoGram is secure and free from bugs and viruses, we cannot promise that it will be and have no control over any User Content.
    8.8 In case of interruption of the functionalities of EscoGram, we undertake to restore them as promptly as possible.
    8.9 Unless caused by gross negligence or intentional misconduct, Bosa Group S.R.L., its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, representatives will not be liable to you for any direct, indirect, special (including so-called consequential damages), statutory, punitive, or exemplary damages arising out of or relating to your access or your inability to access EscoGram or the Content. This exclusion applies regardless of theory of liability and even if you notified Bosa Group S.R.L. about the possibility of these damages or the company knew or should have known about the possibility of these damages.
    8.10 We can but we are not obligated to moderate or review any of User Content to verify compliance with the Terms of Service and/or any applicable law.
    8.11 In any case, we cannot guarantee that EscoGram contents and User Contents are appropriate or lawful in other Countries outside Romania. If the User should identify the above-described situations, please do not access EscoGram. Nevertheless, in case the User decides to access EscoGram and use its services, this will happen exclusively under his/her own responsibility and freedom of choice.
    8.12 It is our policy to suspend access to any User Content posted on EscoGram which we become aware may not comply with the Terms of Service and/or any applicable law whilst we investigate the suspected non-compliance or unlawfulness of such Content. If we suspend access to any of User Content, the User may request a review of our decision to suspend access to the relevant Content by contacting us at support@EscoGram.com. Following our investigation of the suspected non-compliance or unlawfulness of the relevant Content, we may take any action we consider appropriate, including to reinstate access to the Content or to permanently remove or disable access to the relevant Content without needing to obtain any consent from the User and without giving any prior notice. The User agrees that he/she will at his/her own cost promptly provide to us all reasonable assistance (including by providing us with copies of any information which we request) in our investigation. We will not be responsible for any loss suffered by the User arising from the suspension of access to User Content or any other steps which we take in good faith to investigate any suspected non-compliance or unlawfulness of User Content under this section.
    8.13 If we suspend access to or delete any of User Content, we will notify the User via e-mail or electronic message to User’s EscoGram account, but we are not obligated to give a prior notice of such removal or suspension.
    8.14 We reserve the right in our sole discretion to terminate User’s agreement with us and User’s access to EscoGram for any reason, by giving the User 30 days’ notice by e-mail or electronic message to User’s EscoGram account. We can also suspend access to User’s account or terminate User’s agreement with us and User’s access to EscoGram immediately and without prior notice:
    a. if we think that the User has or may have seriously or repeatedly breached any part of the Terms of Service, or if the User attempts or threatens to breach any part of the Terms of Service in a way which has or could have serious consequences for us or another User; or
    b. if the User takes any action that in our opinion has caused or is reasonably likely to cause us to suffer a loss or that otherwise harms the reputation of EscoGram.
    8.15 If we suspend access to the User’s account or terminate User’s agreement with us and User’s access to EscoGram we will let the User know. During any period when access to User account is suspended, any Client Payments which would otherwise have fallen due during the period of suspension will be suspended, and we may withhold all or any part of the Model Earnings due to the User but not yet paid out in accordance with section 13 of the Terms of Use for Models.
    8.16 Upon termination of User’s account, we may deal with User Content in any appropriate manner in accordance with our Terms of Service and Privacy Policy, and the User will no longer be entitled to access User Contents. There is no technical facility on EscoGram for the User to be able to access User Contents following termination of User’s account.
    8.17 We can disclose any information or records in our possession or control about User’s use of EscoGram to law enforcement agencies in connection with any law enforcement investigation of any suspected or alleged illegal activity, to protect our rights or legal interests, or in response to legal process.
    8.18 We can change the third-party payment providers used to process payments on EscoGram and if we do so, we will notify you and store applicable details on your EscoGram account.
    8.19 We do not authorize or approve any User Content on EscoGram, and views expressed by Users on EscoGram do not necessarily represent our views. We do not grant the User any rights in relation to any User Content. Any such rights may only be granted to the User by the Model. that posted that User Content.
    8.20 User Content may be viewed by individuals that recognise User’s identity. We will not in any way be responsible to the User if he/she is identified from his/her User Content.
    8.21 All User Contents are created, selected, and provided by Users and not by us. We are not responsible for reviewing or moderating any User Content, and we do not select or modify any User Content that is stored or transmitted via EscoGram. We are under no obligation to monitor any User Content or to detect breaches of the Terms of Service.
    8.22 The User agrees that you he/she has no obligation to follow any suggestions, comments, reviews, or instructions received from another User of EscoGram and that if you choose to do so, you do so entirely at his/her own risk.
    8.23 We make no promises or guarantees of any kind that Users will make a particular sum of money (or any money) from their use of EscoGram (including the EscoGram Referral Program).
    8.24 The materials which we make accessible on EscoGram for Users are for general information only. We make no promises or guarantees about the accuracy or otherwise of such materials, or that Users will achieve any particular result or outcome from using such materials.
    8.25 We are not responsible for any lost, stolen, or compromised User’s account, password, e-mail accounts, or any resulting unauthorized activities or resulting unauthorized payments or withdrawals of funds.
    8.26 The User acknowledges that once his/her User Content is posted on EscoGram, we cannot control and will not be responsible to the User for the use which other Users or third parties make of such User Content, including copying, distributing, reposting elsewhere, infringing copyright, or disclosing the User’s identity or any User’s personal information without User’s consent.
    8.27 Bosa Group S.R.L. and our subsidiary companies, employees, owners, representatives, and agents will not be liable to the User for any loss of profit, loss of business or revenue, business interruption, loss of business opportunity, loss of data or information (including any User Content), or loss of anticipated savings, or for any indirect or consequential loss or damage, suffered by the User arising from or in connection with the use of EscoGram.
    9. THIRD-PARTY WEBSITES AND CONTENTS
    9.1 EscoGram may contain references (or links) to third-party websites, contents and materials stored on third-party servers, which are not in any way controlled or monitored by us. Therefore, we decline any possible liability related to these third-party websites’ content, operation, accuracy, lawfulness, reliability, privacy policy or other policies and disclosures.
    9.2 The mere possibility of directly accessing from EscoGram to third-party websites, contents and materials, does not in itself imply the approval or sponsorship of these. For this reason, we shall not be liable for any loss, damage or cost incurred by the User or by third parties. Likewise, we don’t guarantee that these third-party websites, contents and materials are regularly updated.
    9.3 By deciding to access to third-party websites, contents and materials, the User acknowledges and accepts that the Terms of Service, and any other note, legal notice, statement or disclaimer that may be published anywhere on EscoGram, are no longer valid for third-party websites, contents and materials.
    9.4 We strictly prohibit the use of meta-tags and framing techniques on EscoGram.
    9.5 It is possible to link to the EscoGram homepage only in a way that is fair and legal and does not damage our reputation or take advantage of it. Anyways, it is forbidden to establish a link in such a way as to suggest any form of impersonation, promotion, association, approval, or endorsement on our part.
    9.6 It is strictly forbidden to promote any EscoGram User’s account by using Google Ads or any similar search engine advertising service.
    9.7 We reserve the right to undertake any type of action necessary to protect our rights and legitimate interests in the event of pecuniary or non-pecuniary damages including, by way of non-exhaustive example, damages in terms of honour, reputation or image.
    10. PERSONAL DATA PROTECTION
    10.1 We declare that the processing of personal data of the User, acquired during the browsing and use of EscoGram services and functionalities, will take place, now and in the future, in full compliance with the obligations laid down in the UE Regulation 2016/679 and Romanian regulation (Law no. 506/2004, Law no. 190/2018 and provisions of Romanian Supervisor Authority, Autoritatea Nationala de Supraveghere a Prelucrarii Datelor cu Caracter Personal), according to the terms and for the purposes specified in the Privacy Policy, which the User acknowledges and specifically declares to have read and accepted.
    11. APPLICABLE LAW AND DISPUTE RESOLUTION
    11.1 Without prejudice to the application of the European binding rules for consumer protection, Terms of Service – that are these Terms of Use for all Users, Terms of Use for Clients, Terms of Use for Model, Terms of Use for Affiliate, Privacy Policy and Complaints Policy –, any other note, legal notice, statement or disclaimer that may be published anywhere on EscoGram, as well as the agreement with us shall apply Romanian Law.
    11.2 If the User is a European consumer, he/she will also be able to rely on mandatory rules of the law of the country where he/she lives.
    11.3 All disputes arising between us and any User, related to the use of EscoGram (and relative contents, materials and services) or to the Terms of Service, will be subject to the Romanian jurisdiction.
    11.4 If the User is a European consumer, the disputes can also be subject to the jurisdiction of the country where the User lives.
    11.5 In any case, we inform consumer Users about the existence of a specific European platform for online dispute resolution (ODR) accessible at https://ec.europa.eu/consumers/odr/.
    11.6 You hereby release the Bosa Group S.R.L., its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, representatives from all liability arising out of User submissions or the conduct of other Users or third parties, including disputes between you and one or more other Users or third parties.

    TERMS OF USE FOR CLIENTS

    BY USING OUR WEBSITE AS A CLIENT YOU AGREE TO THESE TERMS PLEASE READ THEM CAREFULLY

    1. PREMISES
    1.1 These Terms of Use for Clients are additional terms which apply if the User registers an account and use EscoGram as a Client. These Terms of Use for Clients form part of the agreement of the User/Client with us.
    1.2 The following terms will also apply in relation to the use of EscoGram and the Client agrees to them:
    a. our Terms of Use for all Users;
    b. our Privacy Policy – which inform on why and how we use User’s personal data, pursuant to art. 13 GDPR;
    c. our Complaints Policy – which sets out the procedure for making a complaint about any aspect of EscoGram, and how we will deal with that complaint;
    d. the Agreement between Client and Model – which does not form part of any agreement with us, but which governs and sets out the terms applicable to each Client/Model Transaction that the User enters into on EscoGram;
    e. Cookie Policy – which applies to all Users and inform on why and how we use User’s cookies;
    f. Return & Cancellation Policy – which applies to all Users and provides information on your rights of withdrawal from the agreemets and of cancellation of the agreement;
    g. Anti-slavery Policy - which applies to the company, its business partners and Users and inform on how we fight against slavery and human-trafficking activities.
    1.3 The Client declares and warrants that he/she:
    a. is at least 18 years old;
    b. if the laws of the country or State/province where he/she lives provide that he/she can only be legally bound by a contract at an age which is higher than 18 years old, then the Client is old enough to be legally bound by a contract under the laws of the country or State/province where he/she lives;
    c. will provide us more information or verification records as we require;
    d. is permitted by the laws of the country or State/province where he/she are located to join EscoGram and to view any User Content and content available on it and to use any functionality provided by it;
    e. is able and willing to make payment where required to view User Contents available on EscoGram and to use functionalities provided by EscoGram;
    1.4 The Client declares to be aware that some of the User Content on EscoGram contains adult material and agrees to take this into account when deciding where to access and view User Content. We will not be responsible to the Client for any loss or damage as a result of accessing or viewing User Content containing adult material in a way which places the Client in breach of any contract he/she has with a third party (for example, employment contract) or in breach of any applicable law.
    2. CLIENT’S OBLIGATIONS
    2.1 In addition to the terms set out elsewhere in the Terms of Service, the Client warrants that for each User Content he/she intend to post or publish or send on EscoGram:
    a. the User Content complies in full with the Terms of Service;
    b. the Client either own such User Content, and all intellectual property rights in it or have a valid license;
    c. if the User Content includes or uses any third-party material, the Client have secured all rights, licenses, written consents and releases that are necessary for the use of such third-party property in the User Content and for the subsequent use and exploitation of that User Content on EscoGram.
    2.2 The Client acknowledges to be liable to and indemnify us if any of the warranties of the section 2.1 above is untrue. This means that the Client will be responsible for any loss or damage we suffer as a result of any warranty being untrue.
    2.3 We are not responsible for and do not endorse any aspect of any User Content posted or sent by the Client or any other User of EscoGram. We do not have any obligation to monitor any User Content and have no direct control over what any User Content may comprise.
    2.4 By using EscoGram, the Client acknowledges and agrees that it is strictly forbidden to form a contract, through EscoGram, with a Model regarding escort or prostitution services. The Client declares he/she understands we are not, and cannot be considered, a mediator, intermediary, or party to any agreements between the Client, Model and any other individual regarding the escort or prostitution services.
    2.5 By using EscoGram, the Client acknowledges and agrees that we do not provide dating services and we do not offer appointment mediation services. EscoGram will not be responsible for any meetings between models and clients. Clients can view photos and videos, start chats, purchase content or webcam services, and find contact numbers, but appointments cannot be arranged through the platform.
    3. SERVICES, TRANSACTIONS AND PAYMENTS
    3.1 The Client can:
    a. purchase on EscoGram the access to User Content of a Model through a Client-Model Transaction;
    b. post public reviews on Model, in their personal EscoGram pages.
    3.2 All Client-Model Transactions are autonomous contracts between Clients and Model on the terms of the Agreement between Client and Model.
    3.3 Although we provide the EscoGram platform, allowing Models to advertise their services or grant paid access to their User Contents and storing such User Contents, we are not a party to the Agreement between Client and Model or any other contract which may exist between a User and an Model, and are not responsible for any Client-Model Transactions.
    3.4 Models are solely responsible for determining the pricing applicable to Client-Model Transactions and the User Content to which may be given access. All prices appear in Euro only.
    3.5 Client Payments include the VAT. VAT which shall be added at the current rate as applicable to Client Payments to the prices established by the Models.
    3.6 To be able to enter into a Client-Model Transaction with a specific Model, the Client should only select, on the Model’s personal page, the User Content (on pay-per-view) to access, by clicking on the padlock icon; then, the Client is routed to the EscoGram payment gateway, which, if the Client has not already entered and stored the data during previous Client-Model Transactions or through the appropriate section of Client’s Dashboard, requests the insertion of payment card data, then asking for confirmation to proceed with the Client Payment.
    3.7 The subscription to the Content published by the Model can be purchased on a weekly, monthly, quarterly (three months) or annual basis. The prices are made public on EscoGram.
    3.8 Models may offer trials to Clients that are not subscribed to their Content. If you purchase a trial, you will receive access to that Model’s content at a discounted rate for the duration of the trial period. At the end of the applicable trial period, you will be charged the full price of the subscription at the beginning of each subscription period, until you cancel your subscription. To avoid any further charges, you must cancel before the end of the trial period. For the avoidance of any doubt, trials are a faculty Models can offer, not an obligation.
    3.9 The Clients understand that beside the User Content included in subscription, the Model can offer additional Content, such as:
    a. Generic photo and video Content, where Models can offer lockable galleries (e.g., a Feet category) through their profiles, which Clients can unlock by paying an additional price;
    b. Personalized Content through the platform’s chat, where Clients will be able to request personalized photos or videos, with additional payments processed directly through the platform.
    c. Webcam service, where Models and Clients can start time-limited webcam sessions, with individual payments processed via the chat.
    3.10 The Client authorizes us and our subsidiary companies to supply the payment card details to a third-party payment provider for the purpose of processing the Client Payment. All Client Payments will be charged in Euro. The payment card provider of the Client may charge currency conversion fees. We do not have control over currency exchange rates or charges imposed by any payment card provider or bank and we and our subsidiary companies will not be responsible for paying any charges or fees imposed by payment card providers or banks.
    3.11 The payment provider will take immediate payments from the Client’s payment card for Client Payments. The Client authorizes and consents to each of these payments being debited using his/her supplied payment card details.
    3.12 The Client agrees to not make unjustified requests for a refund in respect of any Client-Model Transaction, or unjustified chargeback requests of Client’s payment card provider in relation to any Client-Model Transaction. If we consider that any request for a refund or chargeback request was made by the Client in bad faith, we have the right to suspend or delete the Client’s User account.

    BY USING OUR WEBSITE AS A MODEL YOU AGREE TO THESE TERMS PLEASE READ THEM CAREFULLY

    1. PREMISES
    1.1 These Terms of Use for Model are additional terms which apply if the User registers an account and use EscoGram as a Model. These Terms of Use for Model form part of the agreement of the User/Model with us.
    1.2 The following terms will also apply in relation to the use of EscoGram and the Model agrees to them:
    a. our Terms of Use for all Users;
    b. our Privacy Policy – which inform on why and how we use User’s personal data, pursuant to art. 13 GDPR;
    c. our Complaints Policy – which sets out the procedure for making a complaint about any aspect of EscoGram, and how we will deal with that complaint;
    d. the Agreement between Client and Model – which does not form part of any agreement with us, but which governs and sets out the terms applicable to each Client/Model Transaction that the User enters into on EscoGram;

    1.3 The Model declares and warrants that he/she:
    a. is at least 18 years old;
    b. if the laws of the country or State/province where he/she lives provide that he/she can only be legally bound by a contract at an age which is higher than 18 years old, then the Model is old enough to be legally bound by a contract under the laws of the country or State/province where he/she lives;
    c. will provide us, during the account registration procedure, a valid ID card or other valid identification document;
    d. will provide us more information or verification records as we require;
    e. is permitted by the laws of the country or State/province where he/she are located to join EscoGram and to post and publish any User Content on EscoGram and to use any functionality provided by it;
    f. is able and willing to make payment to use functionalities provided by EscoGram;
    1.4 The Model declares to be aware that some of his/her User Content on EscoGram contain adult material and agrees to take this into account when deciding where to post, publish and/or access and view User Content. We will not be responsible to the Model for any loss or damage as a result of posting, publishing, accessing or viewing User Content containing adult material in a way which places the Model in breach of any contract he/she has with a third party (for example, employment contract) or in breach of any applicable law.
    1.5 Only individuals can be Models and are bound personally by the Terms of Service. Our legal relationship is with the Model, not with any third party, and the Model will be legally responsible for ensuring that all User Content posted and all use of Model’s account complies with the Terms of Service.
    1.6 By using EscoGram, the Client acknowledges and agrees that it is strictly forbidden to form a contract, through EscoGram, with a Client regarding escort or prostitution services. The Model declares he/she understands we are not, and cannot be considered, a mediator, intermediary, or party to any agreements between the Client, Model and any other individual regarding the escort or prostitution services.
    1.7 By using EscoGram, the Model acknowledges and agrees that we do not provide dating services and we do not offer appointment mediation services. EscoGram will not be responsible for any meetings between models and clients. Clients can view photos and videos, start chats, purchase content or webcam services, and find contact numbers, but appointments cannot be arranged through the platform.
    2. MODEL’S OBLIGATIONS
    2.1 In addition to the terms set out elsewhere in the Terms of Service, the Model warrants that for each User Content he/she intend to post or publish or send on EscoGram:
    a. the User Content complies in full with the Terms of Service;
    b. the Model either own such User Content, and all intellectual property rights in it or have a valid license;
    c. if the User Content includes or uses any third-party material, the Client have secured all rights, licenses, written consents and releases that are necessary for the use of such third-party property in the User Content and for the subsequent use and exploitation of that User Content on EscoGram;
    d. the Model authorize Users and Clients to access and view the User Content on EscoGram for their lawful and personal use, in compliance with any licence that the Model grant.
    2.2 The Model acknowledges to be liable to and indemnify us if any of the warranties of the section 2.1 above is untrue. This means that the Model will be responsible for any loss or damage we suffer as a result of any warranty being untrue.
    2.3 We are not responsible for and do not endorse any aspect of any User Content posted or sent by the Model or any other User of EscoGram. We do not have any obligation to monitor any User Content and have no direct control over what any User Content may comprise.
    2.4 Model must not post or upload User Content designed to promote, directly or indirectly, a third-party goods, services or image in return for payment.
    2.5 By using EscoGram, the Model warrants that will at all times comply with all laws and regulations relating to Tax which apply to him/her. For the avoidance of doubt, the Model is the solely responsible for his/her own Tax affairs and we and our subsidiary companies are not responsible for advising the Model on any Tax affair or issue, and will not be liable in respect of any general information provided on EscoGram or by Model in respect of Tax, and therefore will not be liable for any non-payment of Tax by any Model.
    2.6 We reserve the right to close any Models EscoGram account if we are notified of or become aware of any Tax non-compliance by the Model.
    3. SERVICES, TRANSACTIONS AND PAYMENTS
    3.1 The Model can purchase on EscoGram a Membership Plan, that let him/her to:
    a. create and publish public and private gallery medias (User Content) on the personal EscoGram page,
    b. add personal information (e.g.: contact data, location) on the personal EscoGram page,
    c. add stories,
    d. advertise their profile with varying visibility on the homepage and city search page.
    3.2 There are three different types of Membership Plan, which respectively offer increasingly advantageous features for the Model: Silver, Gold, Diamond. The benefits and services included in each Membership Plan are better described on EscoGram.
    3.3 Each Membership Plan can be purchased on a weekly, monthly, quarterly (three months) or annual basis. The prices are made public on EscoGram.
    3.4 The Model can also purchase, as a daily upgrade, the specific Model of the Day feature, which allows you to unlock all features and get unlimited access to platform. Its price is specified on EscoGram.
    3.5 Any Client will be able to purchase any Model’s User Content on pay-per-view through a Client-Model Transaction.
    3.6 All Client-Model Transactions are autonomous contracts between Clients and Model on the terms of the Agreement between Client and Model.
    3.7 Although we provide the EscoGram platform, allowing Models to advertise their services or grant paid access to their User Contents and storing such User Contents, we are not a party to the Agreement between Client and Model or any other contract which may exist between a Client and Model, and are not responsible for any Client-Model Transactions.
    3.8 Models are solely responsible for determining (within the parameters for pricing on EscoGram) the pricing applicable to Client-Model Transactions and the User Content to which may be given access. All prices appear in Euro only.
    3.9 Client Payments include VAT. VAT shall be added at the current rate as applicable to Client Payments to the prices established by the Models.
    3.10 The Model authorizes us and our subsidiary companies to supply the payment card details to a third-party payment provider for the purpose of processing the Client Payment. All Client Payments will be charged in Euro. The payment card provider of the Client may charge currency conversion fees. We do not have control over currency exchange rates or charges imposed by any payment card provider or bank and we and our subsidiary companies will not be responsible for paying any charges or fees imposed by payment card providers or banks.
    3.11 The payment provider will take immediate payments from the Model’s payment card. The Model authorizes and consents to each of these payments being debited using his/her supplied payment card details.
    3.12 The Model agrees to not make unjustified requests for a refund in respect of any purchase of Membership Plan, or unjustified chargeback requests of Model’s payment card provider in relation to any purchase of Membership Plan. If we consider that any request for a refund or chargeback request was made by the Model in bad faith, we have the right to suspend or delete the Model’s User account.
    3.13 To be able to purchase a Membership Plan, the Model must click the Buy plan button or on the Upgrade button for the Model of the Day feature in the Membership section of the Model’s Dashboard; then, the Model is routed to the EscoGram payment gateway, which, if the Model has not already entered and stored the data during previous purchases of Membership Plan or through the appropriate section of Model’s Dashboard, requests the insertion of payment card data, then asking for confirmation to proceed with the purchase of the Membership Plan and the payment.
    3.14 Clicking on these buttons to proceed with the purchase requires and implies the full understanding and acceptance of the Terms of Service, and constitutes a binding purchasing acceptance for the Model.
    3.15 When the purchasing acceptance of the Model is received, we will send to the Model an automatic acknowledgement e-mail to confirm the receipt of the purchase acceptance and the conclusion of the agreement between us and the Model, containing:
    a. the Terms of Service applicable to the contract, also available via link at the present webpage;
    b. information about the essential characteristics of the Membership Plan or the service purchased and its price (inclusive of taxes and fees);
    c. our contact details and of our support service.
    4. RIGHT OF WITHDRAWAL
    4.1 The Model explicitly consent to start the services purchased with the Membership Plan during the period of right of withdrawal and acknowledges that he/she is losing his/her right of withdrawal.
    4.2 The right of withdrawal is therefore excluded in the agreement between us and the Model.

    TERMS OF USE FOR AFFILIATE

    a. our Terms of Use for all Users;
    b. our Privacy Policy – which inform on why and how we use User’s personal data, pursuant to art. 13 GDPR;
    c. our Complaints Policy – which sets out the procedure for making a complaint about any aspect of EscoGram, and how we will deal with that complaint;
    d. Cookie Policy – which applies to all Users and inform on why and how we use User’s cookies;
    e. Return & Cancellation Policy – which applies to all Users and provides information on your rights of withdrawal from the agreemets and of cancellation of the agreement;
    f. Anti-slavery Policy - which applies to the company, its business partners and Users and inform on how we fight against slavery and human-trafficking activities.
    1.3 The Affiliate declares and warrants that he/she:
    a. is at least 18 years old;
    b. if the laws of the country or State/province where he/she lives provide that he/she can only be legally bound by a contract at an age which is higher than 18 years old, then the Affiliate is old enough to be legally bound by a contract under the laws of the country or State/province where he/she lives;
    c. will provide us more information or verification records as we require;
    d. is permitted by the laws of the country or State/province where he/she are located to join EscoGram and to post and publish any User Content on EscoGram and to use any functionality provided by it;
    e. is able and willing to receive payment by EscoGram for introducing User registered as Model to EscoGram;
    1.8 The Affiliate declares to be aware that some of the User Content on EscoGram contains adult material and agrees to take this into account when deciding where to access and view User Content. We will not be responsible to the Affiliate for any loss or damage as a result of accessing or viewing User Content containing adult material in a way which places the Affiliate in breach of any contract he/she has with a third party (for example, employment contract) or in breach of any applicable law.
    1.9 Only individuals can be Affiliate and bound personally by the Terms of Service. Our legal relationship is with the Affiliate, not with any third party, and the Affiliate will be legally responsible for ensuring that all User Content posted and all use of Affiliate’s account complies with the Terms of Service.
    1.10 By using EscoGram, the Affiliate acknowledges and agrees that it is strictly forbidden to conduct escort or prostitution services. The Affiliate declares he/she understands we are not, and cannot be considered, a mediator, intermediary, or party to any agreements between the Client, Model and any other individual regarding the escort or prostitution services.
    1.11 By using EscoGram, the Affiliate acknowledges and agrees that we do not provide dating services and we do not offer appointment mediation services. EscoGram will not be responsible for any meetings between models and clients. Clients can view photos and videos, start chats, purchase content or webcam services, and find contact numbers, but appointments cannot be arranged through the platform.
    2. AFFILIATE’S OBLIGATIONS
    2.1 In addition to the terms set out elsewhere in the Terms of Service, the Affiliate warrants that for each User Content he/she intend to post or publish or send on EscoGram:
    a. the User Content complies in full with the Terms of Service;
    b. the Affiliate either own such User Content, and all intellectual property rights in it or have a valid license;
    c. if the User Content includes or uses any third-party material, the Affiliate have secured all rights, licenses, written consents and releases that are necessary for the use of such third-party property in the User Content and for the subsequent use and exploitation of that User Content on EscoGram.
    2.2 The Affiliate acknowledges to be liable to and indemnify us if any of the warranties of the section 2.1 above is untrue. This means that the Affiliate will be responsible for any loss or damage we suffer as a result of any warranty being untrue.
    2.3 We are not responsible for and do not endorse any aspect of any User Content posted or sent by the Affiliate or any other User of EscoGram. We do not have any obligation to monitor any User Content and have no direct control over what any User Content may comprise.
    3. SERVICES, TRANSACTIONS AND PAYMENTS
    3.1 The Affiliate will receive compensation from us for each User introduced to EscoGram who registers as an Model at his/her invitation.
    3.2 This compensation is equal to 9%, VAT excluded, of the first Membership Plan subscribed to by the Model.
    3.3 To be able to receive the compensation, the Affiliate must first add a payment card to his/her User account in the appropriate section of the Dashboard.
    3.4 The Model authorizes us and our subsidiary companies to supply the payment card details to a third-party payment provider for the purpose of processing the payment to the Affiliate. All payments will be charged in Euro. We do not have control over currency exchange rates or charges imposed by any payment card provider or bank and we and our subsidiary companies will not be responsible for paying any charges or fees imposed by payment card providers or banks.
    3.5 The Affiliate authorizes and consents to each of these payments being accredited using his/her supplied payment card details.

    TCOMPLAINTS POLICY

    1. This document set out our complaints policy. If you are a User of EscoGram, this Complaints Policy forms part of your agreement with us.
    2. In this Complaints Policy, defined terms have the same meanings given to them in the Terms of Use for all Users. In addition, the term Business Days means any day which is not a Saturday, Sunday or public holiday in Romania.
    3. Every User can use this Complaints Policy to alert us to any complaint relating to EscoGram and its Users and User Contents.
    4. If you have a complaint about EscoGram, User Contents appearing on EscoGram, or the conduct of a User, you can send your complaint:
    a. by clicking on the appropriate link next to the User or the User Content;
    b. by e-mail to support@EscoGram.com, including name, address and contact details of the complaining User, a description of the complaint and, if the complaint relates to a User Content, its URL.
    5. Following receipt of the complaint:

    6. The User warrant to not make any complaint under this Complaints Policy which is wholly unjustified, abusive, or made in bad faith. If we determine that a User has breached this warranty, we may suspend or terminate his/her User account.
