    Return & Cancellation Policy

    BOSA GROUP S.R.L., a Romanian legal entity, registered at the Trade Register Office attached to the Bucharest Tribunal under no. J2024012889404, having a unique registration code 50305303, headquartered in Bucharest, 3rd District, Sector 3, 317. Calea Călărași street, 1st floor, ap. 2, room nr. 8, e-mail: info@bosagroups.com, sole licensee of the website www.escogram.com , (hereinafter referred to as EscoGram), values the satisfaction of its Clients and Models and wants to ensure a positive experience with the platform. This Return & Cancellation Policy outlines what are the rights and options regarding Clients’ and Model’s memberships.

    1. DEFINITIONS

    In this document, the following terms shall mean:

    1.1 User means that person who accesses EscoGram and who is interested in the Services provided by Bosa Group S.R.L. and/or who registers in order to use the Services provided by Bosa Group S.R.L, has read and accepts the provisions of this policy;
    1.2 Client means a User who follows a Model and is able to view the Model’s content;
    1.3 Model means a User who has set up his/her EscoGram account to post content on EscoGram to be viewed by Clients; Model’s content may be freely available or pay-per-view on the basis of free and autonomous choice of the Model;
    1.4 Buyer means the Client who places an order for the Merchandise;
    1.5 Merchandise means products sold or offered for sale online through EscoGram, consisting in clothing articles and accessories;
    1.6 Generic content sales means the content offered for sale by the Models consisting in lockable galleries through their profiles, which Clients can unlock by paying.
    1.7 Personalized content sales means the sale of personalized photos or videos, requested by the Clients to the Models through the chat available on EscoGram, with payments processed directly through the platform.
    1.8 Services means the functionalities and features offered to Clients and Models to facilitate the online the communication, such as webcam services, text chat, file sharing, live streaming. EscoGram is not a dating service. EscoGram does not offer escort or prostitution services. Through EscoGram it is not possible and it is strictly forbidden to request escort or prostitution services and the platform cannot be considered a mediator, intermediary, or party to any agreements between the Client, Model and any other individual regarding the escort or prostitution services;
    1.9 Subscription means a Client’s binding agreement to obtain access for a specific period of time to all content that a Model makes available to Clients in exchange for authorised automatic renewal payments. This excludes individually priced content;
    2. RETURN POLICY
    2.1 Merchandise
    2.1.1 The Buyer has the right to give up the Merchandise purchased on EscoGram, without penalties and without invoking a reason, within 14 calendar days from the receipt of the products, according to the provisions of Directive 2011/83/EU on consumer rights.
    2.1.2 In order to return the Merchandise, the Buyer must fill in the Return form: https://forms.gle/LqAQmPHKZgRWpgDt5 Return Form and be contacted by Bosa Group S.R.L. with no unjustified delays.
    2.1.3 In all cases of returning the products, the shipping costs for the return will be borne by Bosa Group S.R.L.
    2.1.4 The following Merchandise cannot be returned, by exception to the rule, are Merchandise that is likely to deteriorate or expire quickly or the sealed Merchandise that cannot be returned for reasons of health or hygiene, and which have been unsealed by the Buyer.
    2.1.5 If a different product has been sent than the one ordered or with other specifications (different size, different colour, etc.), the shipping fees will be borne by Bosa Group S.R.L.
    2.1.6 The money will be returned to the Buyer within a maximum of 14 calendar days after Bosa Group S.R.L. has been informed about the decision to withdraw from the contract under the condition that the Merchandise is returned within the 14 days.
    2.1.7 The condition of the returned Merchandise must be the same, it must not show any signs of wear or consumption, otherwise, Bosa Group S.R.L. reserves the right to charge a fee for bringing the Merchandise to saleable condition.
    2.1.8 Merchandise can be returned only accompanied by the purchase invoice.
    2.1.9 The value of the Merchandise will be returned to the same account associated with the payment method with which the Merchandise was paid.
    2.2 Generic content and Personalized content
    2.2.1 Generic content unlocked by the Client by making a payment cannot be returned nor refunded. By agreeing with this Return & Cancellation Policy, the Client confirms that he/she is aware of the loss of their right of withdrawal after unlocking the specific gallery.
    2.2.2 Personalized content such as pictures and videos cannot be returned nor refunded after the Model has provided the Client with the requested content. By agreeing with this Return & Cancellation Policy, the Client confirms that he/she is aware of the loss of their right of withdrawal after being provided with the personalized content.
    2.3 Subscription withdrawal
    2.3.1 The Client explicitly consents to start the provision of the content during the period of right of withdrawal and acknowledges that he/she is losing his/her right of withdrawal.
    2.4 Unjustified refund requests
    2.4.1 By agreeing to this Refund & Cancellation Policy, the Client agrees not to make unjustified requests for a refund in relation to any content and/or Merchandise. If Bosa Group S.R.L. determines that any refund request was made by the Client in bad faith, Bosa Group S.R.L. may suspend or delete the Client’s user account.
    3. CANCELLATION POLICY APPLICABLE FOR CLIENTS
    3.1 The Client can cancel any Subscription at any time. In case of cancellation of a Subscription, the Client can view the relevant Model’s content until the end of the Subscription period in which the Client cancelled, after which no further payments will be taken from the Client in respect of Subscriptions to that Model’s profile, unless a new Subscription to that Model’s profile is made.
    3.2 By agreeing to this Return & Cancellation Policy, the Client agrees and accepts that by purchasing a Subscription, it will automatically renew for additional periods of the same duration unless such Subscription is cancelled by the Client.
    3.3 In case a Subscription is cancelled, the Client understands and agrees that he/she will not receive a refund, and that the Client will be able to continue to access the content provided by the Model only until the end of the existing billing period, at which time the Client will lose access to such content.
    3.4 A Model may choose to offer refunds, discounts or other consideration as a discretionary accommodation. However, each circumstance is unique and a Model’s election to make such an offer in one instance does not create the obligation to do so in another.
    3.5 In case of any changes in the subscription plan, Bosa Group S.R.L. will notify the Client where such change is applicable at least 30 days before the change takes effect to give the Client the opportunity to manage his/her Subscriptions or end the use of the Services provided by EscoGram.
    3.6 If the Client does not wish to accept the change, the Subscription might be cancelled in accordance with the instructions included in the notice and this Return & Cancellation Policy. In such case, the cancellation must be made until the notified change takes effect. If the Subscription is not cancelled before the change takes effect, the Client understands and agrees that will be considered as acceptance of the change notified.
    4. CANCELLATION POLICY APPLICABLE FOR MODELS
    4.1 The Model can cancel the membership plan at any time. In case of cancellation of a membership plan, the Model can use the Services provided by EscoGram until the end of the membership plan period in which the Model cancelled, after which no further payments will be taken from the Model in respect of the membership plan, unless a new membership plan is made.
    4.2 By agreeing to this Return & Cancellation Policy, the Model agrees and accepts that by purchasing a membership plan, it will automatically renew for additional periods of the same duration unless such membership plan is cancelled by the Model.
    4.3 In case a membership plan is cancelled, the Model understands and agrees that he/she will not receive a refund, and that the Model will be able to continue to access the Services only until the end of the existing billing period, at which time the Model will lose access to EscoGram.
    4.4 In case of any changes in the membership plan, Bosa Group S.R.L. will notify the Model where such change is applicable at least 30 days before the change takes effect to give the Model the opportunity to manage his/her membership plan or end the use of the Services provided by EscoGram.
    4.5 If the Model does not wish to accept the change, the membership might be cancelled in accordance with the instructions included in the notice and this Return & Cancellation Policy. In such case, the cancellation must be made until the notified change takes effect. If the membership is not cancelled before the change takes effect, the Model understands and agrees that will be considered as acceptance of the change notified.
    5. THE RETURN & CANCELLATION POLICY IS SUBJECT TO CHANGE
    5.1 Bosa Group S.R.L. has the right to amend or supplement the Return & Cancellation Policy at any time and for any reason.
    5.2 Such revision will be notified by changing the Last Updated date. After the date on which the updated policy is published, accessing the site will represent the User’s acceptance of the respective updated conditions.
